Paying a Private Caregiver: Payroll, Taxes, and Written Agreements

Employee or contractor?
If a family hires someone to work in the home and controls what work is done and how it is done, the caregiver may be a household employee. The IRS explains household employment rules in Publication 926, Household Employer's Tax Guide. The IRS also discusses family caregivers and self-employment tax. Families should verify with a tax professional or payroll service before issuing a 1099 or paying cash.
Set up clean records
- Written job description and duties.
- Hourly rate, overtime rules, and payment schedule.
- Daily time records approved by the family.
- Rules for mileage, errands, meals, and supplies.
- Emergency contacts and incident reporting.
Do not ignore overtime and labor rules
Live-in care, overnight care, and long shifts can create complicated wage questions. State laws may add requirements beyond federal rules. If the schedule is more than occasional help, use a household payroll provider or employment attorney before the first paycheck.
Use a written care agreement
The agreement should say what the caregiver can and cannot do. Include medication boundaries, transportation permissions, keys, privacy, phone use, visitor rules, pets, lifting limits, and what happens if the older adult refuses care. A good agreement protects both the family and the caregiver.
